Terms of Service

1. Acceptance of Terms
By accessing or using the ChatGPTTech website or API platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all users, including visitors and registered account holders.
2. Description of Service
ChatGPTTech provides an OpenAI-compatible API platform that routes requests to third-party AI model providers (including DeepSeek, Seedance, and others). We act as an intermediary; we do not develop or host the underlying AI models. Service availability depends on upstream provider uptime and is provided on an "as available" basis.
3. Account Registration
To access the API, you must create an account with a valid email address. You are responsible for: • Maintaining the confidentiality of your account credentials and API keys • All activity that occurs under your account • Notifying us immediately at [email protected] if you suspect unauthorized access You must be at least 18 years old or the age of majority in your jurisdiction to create an account.
4. Acceptable Use
You agree not to use the Service to: • Generate content that is illegal, harmful, abusive, or violates any applicable law • Circumvent rate limits, access controls, or billing systems • Resell or sublicense access to the API without prior written permission • Conduct automated scraping, crawling, or data harvesting at scale beyond normal API use • Attempt to reverse-engineer, probe, or compromise the platform's infrastructure • Violate the usage policies of any underlying model provider We reserve the right to suspend or terminate accounts that violate these restrictions without prior notice.
5. Billing and Payment
API usage is billed based on token consumption at the rates listed on our pricing page. New accounts receive a one-time free credit. Beyond that: • You authorize us to charge your payment method for usage incurred • Payments are processed by Stripe; your billing information is subject to Stripe's terms • All charges are in USD and are non-refundable except where required by law • We may suspend your account if a payment fails and the balance remains unpaid after a reasonable notice period • You may set usage limits or budget caps within your account dashboard
6. Intellectual Property
The ChatGPTTech platform, branding, and website content are owned by ChatGPTTech. You retain ownership of any content you submit via the API. By using the Service, you grant us a limited, non-exclusive license to process your inputs solely to deliver the API response. We do not use your inputs to train AI models.
7. Third-Party Providers
The Service routes requests to third-party AI model providers. We are not responsible for the output, availability, or policies of those providers. Model behavior, accuracy, and content are subject to each provider's own terms. We make no warranty regarding the suitability of AI-generated outputs for any specific purpose.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED OUTPUTS WILL BE ACCURATE OR RELIABLE.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, CHATGPTTECH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR DATA, ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.
10. Modifications to the Service
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice. We may update pricing with at least 7 days' notice posted on our website. Continued use after changes take effect constitutes acceptance of those changes.
11. Termination
You may terminate your account at any time by contacting us. We may terminate or suspend your account at our discretion if you violate these Terms, engage in fraudulent activity, or for any other reason with reasonable notice where practicable. Upon termination, your right to use the Service ceases immediately. Unused credits are non-refundable unless required by law.
12. Governing Law
These Terms are governed by the laws of the United States. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, unless you opt out in writing within 30 days of account creation. Nothing in this section prevents either party from seeking injunctive relief in a court of competent jurisdiction.
13. Changes to Terms
We may update these Terms from time to time. We will notify registered users of material changes via email or an in-app notice. The updated effective date will be posted at the top of this page. Continued use of the Service after the effective date constitutes your acceptance.
